The Antritrust Roller Coaster: No Poach and Other Restrictive Covenants

This program will review developments relating to antitrust liability for companies that enter into no poach/no hire restrictions that limit employee mobility, what can be expected from the FTC and the DOJ after the withdrawal of key antitrust guidance related to human resource policies and practices, and what the next generation of challenges to noncompete agreements from these agencies is likely to look like. Considering the new administration and new faces at the DOJ, we will examine what changes may be coming that employers need to prepare for.
