Conducting Legal Investigations in the Wake of #MeToo

Effective internal investigation of discrimination, harassment, code of conduct and other policy violations is a critical component of employment law liability prevention. This interactive session will address strategies responsive to recent workplace dynamics, such as the #MeToo movement and the ongoing litany of high-profile accusations. Littler lawyers will also cover the following:
- Considerations that impact effective internal investigations in the current climate
- The investigator's role – where it begins and ends
- Practical complaint “intake" strategies
- Attorney-client considerations
- Development of the investigation plan, including documentation
- Witness interview and information gathering techniques
This will be a unique workshop-style session, where participants will play out steps in a workplace investigation. The presenters will then offer feedback and suggested response strategies to common scenarios regarding effective strategy and areas for improvement, individually and organizationally.
