This presentation will explore the best practices and methodologies for assessing the application of FMLA and ADA from existing, but little-known, provisions of the regulations and case law. Can employers push back when an employee makes an unreasonable FMLA or ADA request? In the litigious times we live in, many human resources professionals and attorneys have come to believe the answer is always “no.” Employers are so often told what they cannot do, it is easy to lose sight of everything they can do. Topics for this informative and practical discussion include:

  • Pushing back on certification problems and how to initiate the discussion
  • The appropriateness of medical exams or testing
  • Frustrating requests for reasonable accommodation
  • How to handle performance problems in the context of ADA and FMLA
  • When to give the notice, even if the employee doesn't ask
