Medical Marijuana in the Workplace: What Employers and Employees Must Know

Many states have decriminalized marijuana use, permitted its medical use, and four states have approved recreational marijuana consumption. These dramatic changes, coupled with marijuana’s continuing illegal status federally, have led to a spate of litigation against employers alleging discrimination and violations of state statutes, as well as challenging issues under the unemployment and worker compensation regimes. Although to date the courts have ruled that employers need not accommodate marijuana use, at the end of the day employers remain concerned about impairment at work due to marijuana consumption and how employers can determine impairment.Our panel of experienced employment lawyers will explore all of these developments and attempt to provide sensible and practical advice for both employers and employees' counsel who are increasingly called upon to address these issues.
