Reduction in Force Master Class: Strategic Workforce Adjustments in a Changing Political Climate
The drastic actions of the Department of Government Efficiency (DOGE) along with general uncertainty in the economy has caused companies across all industry sectors to restructure operations in the U.S. and internationally to reduce employment in impacted or unprofitable lines of business. - Analyze the impact of the Department of Government Efficiency's actions and broader political and economic uncertainties driving the need for strategic workforce adjustments and potential RIFs
- Navigate the key legal considerations for U.S. and global RIFs, including performing a legally compliant and privileged adverse impact analysis, complying with the Older Worker Benefit Protection Act, analyzing job actions under the Worker Adjustment and Retraining Notification Act (WARN) including attributing remote workers, state release requirements, discrimination laws, international considerations, and other relevant regulations to minimize legal risks during a RIF
- Develop a strategic approach to RIFs, including developing and documenting selection criteria, communication strategies, severance considerations, retention arrangements, and outplacement
- Review sample forms, checklists, and legal surveys to ensure a legally sound and well-documented RIF process
- Engage with experienced Littler attorneys and discuss real-world scenarios, challenges, and best practices in managing workforce adjustments in the current climate
